Virginia has some of the nation's most stringent penalties for people who drink and drive. Virginia DUI/DWI Laws target repeat offenders and drivers with high Blood Alcohol Content levels (BAC). A person convicted of a third DUI/DWI conviction within 10 years, is a felony punishable by one to ten years in a penitentiary and would have their car seized by the state and in addition their privilege to drive would be revoked by the trial Judge and the DMV. The General Assembly has past and the Governor approved a mandatory jail term of five (5) days for first offense with a BAC of 0.15 or 20 days in jail for a second offense. If you are arrested within three (3) hours of a crash, Police can arrest without a warrant at any location. A magistrate can deny bail for repeat DUI/DWI Offenders with three convictions in the last five years. Virginia law requires that an ignition-interlock system be installed on cars driven by offenders who receive a restricted license for a DUI conviction involving a minimum 0.15 BAC.
