Rather, Belgarde simply failed to look through the public record.
We hold that Belgarde's motion for a new trial is time-barred. Furthermore, because the State has not made any discovery violations, Belgarde's request that we remand this case to the District Court for a hearing to determine appropriate sanctions under Section 46-15-329, MCA, is also denied.
Affirmed.
