Knight v. City of Aberdeen9/7/2004 in this opinion, the circuit judge was justified in finding Knight guilty as charged. Therefore, we find no merit in Knight's contention that the evidence was insufficient to support his conviction of driving under the influence, first offense.

THE JUDGMENT OF THE CIRCUIT COURT OF MONROE COUNTY OF CONVICTION OF DRIVING UNDER THE INFLUENCE, FIRST OFFENSE, AND SENTENCE OF TWO DAYS' INCARCERATION IN THE MONROE COUNTY JAIL, WITH SENTENCE SUSPENDED, PAYMENT OF $1,000 FINE AND 180 DAYS OF UNSUPERVISED PROBATION, IS AFFIRMED. ALL COSTS OF THIS APPEAL ARE ASSESSED TO THE APPELLANT.
