Kemp v. Commonwealth5/11/1993
Va. App. at 965, 407 S.E.2d at 694. See generally People v. Underwood, 153 Mich. App. 598, 396 N.W.2d 443 (1986).
For these reasons, we reverse the conviction and dismiss the charges against Kemp. See Breeden, 14 Va. App. at , 421 S.E.2d at 676; Wendel, 12 Va. App. at 965, 407 S.E.2d at 694. We need not decide the remaining questions presented in this appeal.
Reversed and dismissed.
