People v. Williams9/30/2004 id not establish the elements of the offense, or speak to the level of his intoxication or impairment. His admissions merely corroborated other, overwhelming evidence that he had been drinking. Defendant suggests his statements "were used to try to show that he had lied to the officers about the nature and extent of his alcohol consumption." But even if the jury concluded that defendant must have lied to the officers concerning the extent of his drinking, that lie had little, if any, significance to the verdicts given the balance of the evidence presented to the jury. And defendant's credibility was not itself a significant issue, particularly since he did not testify. Under the circumstances, the jury's verdict was necessarily predicated on the other evidence and error in the admission of defendant's statements to the officers, if any, was harmless beyond a reasonable doubt.
DISPOSITION
The judgment is affirmed.
