People v. Smith9/9/2004 Randall Eugene Smith appeals from the judgment entered following his plea of guilty to driving under the influence of an alcoholic beverage (DUI) causing injury. (Veh.Code, § 23153, subd. (a).) Appellant admitted suffering two prior DUI convictions (Veh.Code, § 23152, subd. (a)) and admitted suffering three prior prison terms within the meaning of Penal Code section 667.5, subdivision (b). [FN1] The trial court sentenced appellant to four years state prison and ordered appellant to pay $22,225.87 victim restitution (§ 1202.4, subd. (f)), a $800 restitution fine (§ 1202.4, subd. (b)), and a $800 parole revocation fine (§ 1202.45). We appointed counsel to represent appellant in this appeal. After examination of the record, counsel filed an opening brief in which no issues were raised. On July 7, 2004, we advised appellant that he had 30 days within which to personally submit any contentions or issues that he wished us to consider. No response has been received to date. We have reviewed the entire record and are satisfied that appellant's attorney has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441.)
The judgment is affirmed.
