McDermott v. McDonald5/17/2001 all pertinent information regarding the prisoner." McDermott, while not a convicted sex offender, had four counts of incest dismissed pursuant to a plea bargain. He has been identified as having severe sexual problems. His completion-or lack of completion-of the SOP is pertinent to his ability to be released without "detriment to the . . . community" and "to fulfill the obligations of a law-abiding citizen." Therefore, the Board was well within its authority to consider McDermott's refusal to enroll in the recommended SOP when it denied his application for an early release.
McDermott's petition for a writ of habeas corpus is DENIED.
