People v. Garcia5/14/2003 t she later drove while intoxicated. The primary proof of her intoxication was the evidence of her blood alcohol level and the officer's observations of her condition at the time of her arrest. While some of the evidence, that is, the condition of defendant's car, was relevant to both cases, this evidentiary overlap did not require that the prosecutor consolidate the actions. Accordingly, the trial court did not err in denying the motion to dismiss.
III. Disposition
The judgment is affirmed.
