Lash v. County of Henrico10/29/1991
of evading a police officer after receiving a signal to stop without violating any traffic regulation. He can also be guilty of reckless driving without evading a police officer. These two offenses are based upon different and distinct acts and neither is barred by Code § 19.2-294. The majority has ignored the language of the statute and a long
line of Supreme Court decisions.
For the foregoing reasons, I would affirm the judgment of the trial court.
