[T] City of Devils Lake v. Alford4/15/2003
AFFIRMED.
[ ] Denval Alford appeals his conviction for driving under the influence of alcohol to allow for review of the adverse ruling on his motion to suppress evidence. Alford argues the trial court abused its discretion when it refused to suppress evidence obtained after a law enforcement officer stopped Alford's vehicle based upon a "hunch" rather than a reasonable and articulable suspicion. We conclude the trial court did not abuse its discretion in admitting evidence Alford was driving under the influence obtained after a law enforcement officer observed Alford roll through a stop sign without stopping. We summarily affirm under N.D.R.App.P. 35.1(a)(4).
