People v. Cortes8/12/2004 any abuse of discretion by the trial court did not adversely affect appellant's sentence, the matter need not be remanded. (People v. Washington (1994) 27 Cal.App.4th 940, 944.)
V. Error in the abstract of judgment
The parties agree that the abstract of judgment erroneously indicates that appellant was convicted in count 3 of driving under the influence causing injury, although he was actually convicted in that count of leaving the scene of an accident that resulted in injury, a violation of section 20001, subdivision (a). We will therefore direct the trial court to correct the abstract of judgment to properly reflect the offense of which appellant was convicted in count 3. (People v. Mitchell (2001) 26 Cal.4th 181, 188.)
DISPOSITION
The judgment is affirmed and the trial court is directed to correct the abstract of judgment to reflect a conviction in count 3 of leaving the scene of an accident that resulted in injury in violation of section 20001, subdivision (a).
