State v. Doyle11/18/2003 jury found defendant not guilty on this charge. The defendant has failed to show that defense counsel's actions were deficient or that this deficiency was prejudicial to the defense in his case. Defendant's assignment of error is overruled.
VII. Conclusion
Defendant failed to show that the trial court erred in denying his motion to dismiss the first-degree felony murder charge and in denying his requested jury instructions. Defendant failed to present any new arguments or authority in support of his contention that the "shortform" indictment was unconstitutional. Defendant failed to show that defense counsel provided ineffective assistance of counsel.
No error.
Judges MCCULLOUGH and BRYANT concur.
