Wilhelm v. Commonwealth1/20/2004 conviction occurred well before the effective date of the Act is immaterial. DOT concedes that in Alexander v. Department of Transportation, Bureau of Driver Licensing, 822 A.2d 92 (Pa. Cmwlth. 2003), this Court held that a licensee must have two DUI convictions after the effective date of the Act, September 30, 2000, in order for the Law to apply.
Here, as in Alexander, Wilhelm received only one DUI conviction after the effective date of the Act. As a result, the provisions of Section 7002(b) of the Act, 42 Pa.C.S. §7002(b), are inapplicable.
Accordingly, we affirm.
