Eichelberger v. Commonwealth3/18/2004
f Transportation, Bureau of Driver Licensing, 822 A.2d 92 (Pa. Cmwlth. 2003), retroactive application of the Interlock Act is prohibited. Additionally, a review of the record establishes that neither party raised the issue of retroactive application before the trial court. As the trial court's decision was based solely on Schneider and not on retroactive application, we decline to consider this issue on appeal.
Accordingly, the order of the trial court is affirmed.

AND NOW, this 18th day of March, 2004, the order of the Court of Common Pleas of Chester County is affirmed.
