Because the record does not support the trial court's decision to permit the Licensee to file the appeal nunc pro tunc, the trial court lacked jurisdiction to hear the appeal. Accordingly, the order of the trial court is vacated, and the suspension of her operating privilege imposed by the Department is reinstated.

ORDER
AND NOW, this 27th day of February, 2004, the order of the Court of Common Pleas of Delaware County in the above-captioned matter is hereby vacated, and the one-year suspension of Candace Isaac's operating privilege imposed by the Department of Transportation, Bureau of Driver Licensing is reinstated.
