State v. James12/20/2004 nce that he was not a long-term user of crack cocaine. Based on the foregoing, we find the entirely circumstantial evidence in this case was not substantial and merely raised a suspicion that James intended to distribute crack cocaine. Therefore, we hold the trial judge erred in failing to direct a verdict on the possession with intent to distribute crack cocaine charge as well as the related proximity charge.
Accordingly, James's convictions and sentences are
REVERSED.
STILWELL and SHORT, JJ., concur.
