asoned trial lawyer would prefer an incorrect instruction of a crime's element rather than an adverse comment on the evidence by the trial court, as occurred here. Because of the close factual controversy, the trial court's giving the instruction clearly denied appellant a fair trial and constitutes fundamental error. For these reasons, I concur in part and dissent in part.
