Agli v. State10/10/2001 ginally announced in State v. Chaney and now codified in AS 12.55.005.
In AS 12.55.005, the legislature announced the goals of the elimination of unjustified disparity and the promotion of uniformity in sentences. To promote these policies, the legislature directed that a defendant's offense had to be considered in relation to other offenses. Because Agli's sentence is "significantly different from sentences given to similarly situated offenders," we must remand this case to the superior court for findings on the reason for the difference between Agli's sentence and the sentences in the cases discussed above.
Accordingly, we REMAND the case to the superior court for additional findings on the issues we have identified above. The court shall transmit those findings to this court within ninety days. No later than thirty days after the court transmits those findings, each party may submit supplemental memoranda addressing the superior court's findings. We retain jurisdiction.
