Dumas v. Commonwealth12/8/2005 l the morning of the hearing to request a continuance after opposing counsel and the Commonwealth's witnesses were present in court.
Dumas also fails to explain how the continuance would have changed the outcome of the case. Dumas testified that the reason why he filed his appeal late was because he did not receive the notice of suspension. Dumas' testimony was contradicted by the certified documents properly admitted into evidence. The trial court's denial of a continuance under the circumstances was reasonable and not an abuse of discretion and, unquestionably, was not the result of any ill will or bias.
The trial court is affirmed.
ORDER
AND NOW, this 8th day of December, 2005, the order of the Court of Common Pleas of Lebanon County in the above-captioned case is hereby affirmed.
