These issues were raised before the trial court and ably disposed of in the opinion of the Honorable Peter J. O'Brien. Therefore, this Court shall affirm on the basis of that opinion. Brockett v. Commonwealth of Pennsylvania, Department of Transportation, (No. 5329 Civil 2000), filed October 8, 2004.
Accordingly, this Court affirms.
AND NOW, this 27th day of May, 2005, the order of the Court of Common Pleas of Monroe County in the above-captioned matter is affirmed.
