People v. Beaudoin1/4/2005 e vodka to apartment number 48, an apartment occupied by Katherine Markes and him. She brought him the drink, stayed for about 15 minutes, then returned to Jennifer's apartment.
Shortly thereafter, Hurst went to Jennifer's apartment, and Debra invited him in. Soon, defendant Beaudoin walked in without knocking. Debra testified she was then forced to take a pill. Beaudoin had a pill he said was Ecstasy. Debra did not want to take it because she did not know how it would affect her. Beaudoin told her the pill "would make feel hot." Hurst said if she did not take the pill, something would happen, but Debra could not remember exactly what Hurst said. When Debra again protested, Beaudoin hit her in the stomach and forced the pill into her mouth. Debra recalled Hurst at some point putting her on Beaudoin's lap.
Debra remembered being carried downstairs by Hurst. When she asked him what he had given her, Hurst responded, "Shut up. I didn't give you nothing." Debra next recalled being in "a different place." She recalled being put inside an SUV, but she did not know who put her there. She was nude. Hurst held her arms above her head while Beaudoin raped her, then Beaudoin held her arms above her head while Hurst raped her.
Mindi Jones resided in apartment 47, immediately below Markes' apartment 48. About 3:00 a.m. that night, while watching television, Jones saw two men pass by her sliding glass door. Hurst was carrying a young woman on his shoulder. Jones went out to the front of her apartment, and saw Hurst walking up the stairs to apartment 48. She saw the young woman lying down against the stairs. The other man grabbed the young woman and took her up the stairs to apartment 48. This man had a shaved head. (It was established that on that night, Beaudoin's head was shaved.) After the men took the woman inside apartment 48, Jones heard a woman scream, "Stop, leave me alone." Jones called the police.
El Dorado County Deputy Sheriff Birk Johnson arrived at the apartment complex around 3:00 a.m. and went up to apartment 48. At the door, he could hear movement and sobbing. Another deputy sheriff then joined Johnson outside the apartment. Johnson knocked on the door. He heard some movement inside, but nothing else. Johnson knocked on the door again, this time announcing it was the sheriff's department, but got no response. Johnson pounded on the door and announced their presence even louder. There was still no response. Johnson called for additional assistance.
He pounded on the door again and announced his intention to force the door open. Receiving no response, Johnson kicked the door open. It opened slightly, but Johnson had to kick it again. He then pushed the door open, and discovered there was a chair wedged under the inside doorknob. A television in the living room and a kitchen light were on, but the apartment was otherwise dark and quiet.
In the first bedroom, Johnson found Hurst sitting on a chair. Johnson ordered Hurst to raise his hands, but Hurst did not move. He remained sitting, facing straight ahead. Johnson ordered Hurst to raise his hands twice more before Hurst raised his hands a short distance off his thighs. Johnson grabbed Hurst's left wrist and pulled him to the ground. As he handcuffed Hurst, Johnson noticed for the first time someone lying on the lower bunk of a bunk bed in the room. Johnson escorted Hurst to the living room where another deputy was waiting, then returned to the bedroom. He found Debra lying under the bed covers.
Debra was wearing only a pair of sweatpants. Johnson found a t-shirt on the floor, gave it to her to wear and had her stand up. Johnson noticed her pupils were dilated. As she stood, De
