People v. Lorms10/30/2002 , including Lorms's prior criminal history and his continued abuse of alcohol, outweighed the mitigating circumstance that Lorms's alcohol consumption significantly reduced his culpability for the current offenses. The court imposed a consecutive term of eight months for the conviction arising from the November 17 incident, finding that the crimes were committed at different times and places and were not so closely related as to indicate a single period of aberrant behavior. Lorms was awarded credit for time served under subdivision (b) of section 2900.5 of the Penal Code. He was ordered to pay a restitution fine of $1,000 for each conviction. (Pen. Code, § 1202.4, subd. (b).) An additional restitution fine of $1000 for each conviction was suspended pending his successful completion of parole. (Pen. Code, § 1202.45.) Because the court was unable to ascertain the loss claimed by the victim injured on November 11, it retained jurisdiction on the issue of victim restitution. (Pen. Code, §§ 1202.4, subd. (f), 1202.46.)
Lorms's appellate counsel has filed a brief raising no issues and asks us to independently review the record under People v. Wende (1979) 25 Cal.3d 436. We agree with counsel that there are no issues warranting further briefing in this case. The record does not reflect any error in the court's determinations concerning Lorms's competency, the subsequent acceptance of the no contest pleas, or the sentence.
Disposition
The judgment is affirmed.
