While Martinez offers an innocent explanation for what the citizen reported and the officer saw that night, the trial court concluded the officer had specific and articulable facts sufficient to justify an investigative traffic stop. The court found the officer a reasonable suspicion Martinez had been running his vehicle into the alley wall because a citizen reported it, and the officer's own observations reflected activity consistent with that report. The court concluded that repeatedly crashing one's vehicle into a wall in an effort to make a three-point turn, especially when there is a large open area a short distance away where the turn could be easily negotiated, is the type of activity that a police officer should investigate. The driver could be damaging private property, or his actions could reflect that he was driving under the influence . Based on this, the trial court denied the motion.
On appeal, we resolve all evidentiary conflicts and draw all reasonable inferences in favor of the lower court's decision, and exercise our independent judgment in answering the legal question as to whether the court's conclusion the detention and search was constitutionally reasonable. (People v. Overten (1994) 28 Cal.App.4th 1497, 1504.) We have independently reviewed the record. Based upon our review, we conclude the officer had sufficient specific and articulable facts to justify an investigative stop.
Accordingly, the judgment is affirmed.
