People v. Nyabere10/10/2002
NOT TO BE PUBLISHED IN THE OFFICIAL REPORTS
California Rules of Court, rule 977(a), prohibits courts and parties from citing or relying on opinions not certified for publication or ordered published, except as specified by rule 977(b). This opinion has not been certified for publication or ordered published for purposes of rule 977.
Bernard Nyabere appeals the judgment (order revoking probation) entered after conviction following plea of no contest to possession of an illegal telecommunications device, obtaining telephone services by fraudulent use of false, altered or stolen identification, two counts of sale of a device intended to avoid lawful telephone charges and grand theft in case No. GA025227, filing a false instrument in case No. GA036160, and false personation and driving under the influence , a misdemeanor, in case No. KA044363. (Pen. Code, §§ 502.8, subd. (d), 502.7, subds. (a)(5), (b)(1), 487, subd. (a), 115, subd. (a), 529; Veh. Code, § 23152, subd. (b). The trial court sentenced Nyabere to a term of six years and two months in state prison.
We appointed counsel to represent Nyabere on this appeal. After examination of the record, counsel filed an opening brief in which no issues were raised and which requested this court to conduct an independent review of the record. By notice filed April 2, 1999, we advised Nyabere to submit any contention, ground of appeal or argument he wished this court to consider within 30 days. No response has been received to date.
We have examined the entire record and are satisfied Nyabere's counsel has complied fully with counsel's responsibilities. (People v. Wende (1979) 25 Cal.3d 436, 443.)
DISPOSITION
