n's double jeopardy challenge to his sentence was not raised by a timely appeal, the district court lacked jurisdiction to address it. Therefore, the district court's decision holding that Jensen could not be sentenced for both battery and resisting an officer is reversed. The district court's determination that the sentences imposed were neither excessive under state law standards nor cruel and unusual under constitutional standards, is affirmed.
