Chase v. State5/3/2000 or record on probation, and in spite of having numerous opportunities, had not been sufficiently motivated to overcome his substance abuse problem. She concluded that she had no choice but to impose four years of additional incarceration.
Chase has a long history of substance abuse. He committed his original murder offense while under the influence of alcohol. In spite of serving a substantial sentence on that offense, and in spite of having been given several opportunities to treat his substance abuse problem, Chase has continued to violate his probation by consuming cocaine and has also avoided probation supervision by failing to keep in contact with his probation officer. Given the seriousness of Chase's original offense and his long history of failures on probation, Judge Andrews was not clearly mistaken in imposing the additional four years of imprisonment.
The sentence is AFFIRMED.
