Spangenberg v. State10/18/2000
Spangenberg to perform a series of three sobriety tests, he failed them all and even had difficulty following instructions in performing them. Finally, Jennings testified that he found a small cooler of beer and one empty beer can behind Spangenberg's seat. Although Arizola's testimony that Spangenberg had not been drinking is somewhat mitigating, it is not strong enough to undermine the jury's finding of guilt or to render it manifestly wrong or unjust. Spangenberg's fourth issue is overruled.
The judgment of the trial court is affirmed.
