DUI Attorney Charged with DUI


60 year old Steve Dorsey Kackly was charged with driving under the influence of alcohol or drugs, first offense and fleeing/eluding a law enforcement officer.  Kackly, a DUI attorney will has his arraignment set for June 15th after being stopped for traveling 75 miles per hour on a 45 miles per hour road on Saturday at 1:35 a.m. He is allegedly being charged with driving under the influence .  The first breath sample taken from Kackley revealed his blood alcohol level at a .047 and the second .049.

Deputy Richard Kilborn III, a Highlands County deputy in Sebring, Florida, clocked Kackley on Payne Road.  After the deputy turned his lights on the vehicle still continued down the road, heading south.  Kackley continued on for about a half-mile before stopping.  The deputy was able to smell alcohol on Kackley’s breath.  He claims he did not see the lights or hear the siren, to explain why he did not immediately stop.

In 2006, the Florida Supreme Court put him on a two year probation with the Florida bar after swearing at prosecutors and writing an unprofessional letter to Judge Peter Estrada.  His probation does not end until July of this year.

"It would be highly unlikely that a lawyer would be disbarred for two misdemeanors," Marvin said via e-mail. "Either of those charges could be bumped up to a felony and that would be a different story. If he had a prior disciplinary history, that would also subject him to enhanced discipline.  If he is convicted of a felony, there is a presumption of disbarment, which can be overcome," stated Kenneth Marvin, staff counsel for the Florida Bar.
