When interviewed by Miami Beach police, “Burn Notice” star Jeffrey Donovan claimed he was “only borderline and not too drunk” when he was busted for DUI the other night.

The Amesbury hometown boy, who films the USA Network dramedy in the sunny locale, flunked a sobriety test when pulled over by Miami’s finest after the cop heard “a loud tire screech behind me,” TMZ.com reported yesterday.

The cop said he saw Donovan’s car swerve left to avoid hitting the police car, according to his report. And when he finally stopped, the actor ill-advisedly told the law: “Sorry, I didn’t see the red light or your stopped car.”

The officer, after getting a whiff of alcohol, asked Donovan if he had anything to drink. Jeffrey responded: “I had three drinks at the Fontainebleau,” the report states.

After blowing the field sobreity tests, he was taken into custody and reportedly told the cop: “The only mistake I made tonight was drinking Benadryl with 3 glasses of wine.”

Donovan was charged with one count of driving under the influence , but since it’s his first offense, it’s unlikely he’ll do the six-month sentence if he’s convicted.
