State of Georgia v. B.M. (Superior Court of Haralson County)
The client, who had two prior DIU's in the past five years, was stopped for only having one headlight. He allegedly failed the field sobriety tests, and he allegedly refused to take the state breath test by not blowing hard enough. His girlfriend testified that he had only drunk three beers, and during cross-examination it was revealed that the arresting officer had only the most rudimentary training in field sobriety tests and had never completed the Standardized Field Sobriety Testing course. The jury deliberated 35 minutes before finding our client not guilty.
