DUI Road Block Case Ends In No Conviction

Our client was stopped at a DUI road block in St. Johns County in the city of St. Augustine. The first officer said he noticed our client had bloodshot watery eyes and an odor of alcohol on his breath. Our client was ordered out of his car and given a battery of Field Sobriety Exercises by a specially trained DUI officer. Following the FSEs our client was arrested and taken to jail for the breath test. Our client asked some questions about the new Intoxilyzer 8000 and when the questions were not answered he decided not to take the test. He hired our firm and we focused our initial examination on the roadblock guidelines. We then questioned the officers about the manner in which they administered the roadblock and discovered that they were orally amending the procedures used to stop the vehicles. We filed a motion to suppress based on the illegal administration of the roadblock. As a result of this constitutional violation our client was not convicted of DUI or any of the other citations he received.
