Among major changes in D.U.I. law and the upholding of constitutional rights of the accused, Mark N. Weingart has been involved in:
- Changing the law with regard to the definition of actual physical control as it applies to a D.U.I. case;
- Limiting the use of the horizontal gaze nystagmus, or eye test, given by police officers;
- Upholding your right to speak freely and confidentially to an attorney when arrested for D.U.I.;
- Constantly fighting and challenging the legislature's attempts to remove defenses to D.U.I. cases and to protect the constitutional rights of those accused of D.U.I.;
- Limiting the use by police the impact of roadside tests in D.U.I. trials.
Recently, Mark N. Weingart's office has been instrumental in discovering problems with the Intoxilyzer 5000 breath testing machine. Members of his staff were lead counsel involved in consolidated efforts that resulted in the suppression of breath test readings in approximately 1,500 D.U.I. cases.
